First National Deaf New American Conference to Take Place in Syracuse July 28 – July 30, 2022

Ribbon cutting for newly formed Deaf New American Advocacy Inc on Friday, July 29 (9 am) at Embassy Suites Syracuse, Destiny USA, 311 Hiawatha Blvd.   [Syracuse, NY, July 24]—Deaf New Americans face a double isolation, both from the hearing world and resettling in a new, foreign country with a new language and culture. Happily, some extraordinarily devoted Deaf New American Leaders have joined forces to form a new nonprofit and host a first of its kind national conference, highlighting both the challenges and gifts of this diverse community, hailing from around the world. The ribbon cutting will take place on Friday, July 29 (9 am) at Embassy Suites, Destiny USA and will be attended by Mayor Walsh, State Senators and Deaf New Americans from Bhutan, Nepal, Burma, Sudan and Eritrea, among other countries. The conference will run from Thursday, July 28 – Saturday, July 30 2022 at Embassy Suites, Destiny USA and will feature a wide range of sessions, led by advocates, physicians, trauma specialists, service providers and community organizers.  Both the conference and the coalition behind it look to serve as a national model for empowering this diverse, resilient, vital community. Legislation (S.7107-B/A.8586-B) Relates to Supported Decision-Making by People with Intellectual, Developmental, Cognitive and Psychosocial Disabilities Legislation (S.6300-C/A.7356-C) Establishes a Public Awareness Campaign to Combat the Stigma and Stereotyping of Individuals with Developmental Disabilities Legislation (S.6789-A/A.7882-A) Replaces Certain Instances of Term “Mentally Retarded” or Variations of Such Term with Term “Developmentally Disabled” or Variations of Such Term Legislation (S.6195-B/A.7443-C) Replaces Certain References to “Mentally Retarded” or “Mentally Ill” Persons with Term “Individuals with a Developmental Disability”  Legislation (A.7652/S.9335) Eliminates State Residency Requirement for Designated Beneficiaries in the New York ABLE Program Read Governor’s Proclamation Commemorating 32nd Anniversary of Americans With Disabilities Act Here Governor Kathy Hochul today signed a legislative package that further upholds and strengthens the rights of New Yorkers with disabilities. This legislative package encourages autonomy in decision making through a Supported Decision-Making Agreement and seeks to educate the public about the myriad ways people with intellectual and developmental disabilities contribute meaningfully to their communities and reduce harmful stigma and stereotyping. Governor Hochul also issued a proclamation today commemorating the 32nd Anniversary of the Americans With Disabilities Act. “The Americans With Disabilities Act established a comprehensive national mandate prohibiting discrimination against people with disabilities in all its forms,” Governor Hochul said. “With the bills I am signing today, New York State honors the ADA’s legacy by expanding the rights of people with disabilities and combatting stigma so that people with disabilities can live rich and full lives. To make the New York dream a reality, we will continue to make New York inclusive, integrated and accessible for all.” “People with disabilities have the same rights as everyone else and thirty-two years ago, the Americans with Disabilities Act was a critical step to ensuring that people with disabilities could exercise those rights,” said Lieutenant Governor Antonio Delgado.  “Today, New York is taking a step further by enabling supported decision-making for people with disabilities to ensure people can and are making their own decisions and are appropriately supported to do so.” Office for People With Developmental Disabilities Commissioner Kerri E. Neifeld said, “I commend Governor Hochul for signing this package of legislation and for honoring the ADA’s legacy by expanding the rights of New Yorkers with developmental disabilities to make their own decisions. OPWDD is committed to protecting and advancing the rights of people with developmental disabilities to live and work in communities of their choosing and to be free from discrimination.” Chief Disability Officer Kim Hill said, “I am thrilled that not only is Governor Hochul signing a legislative package aimed at protecting and supporting the rights of people with disabilities, but also holding today’s event to acknowledge the importance of the 32nd anniversary of the Americans with Disabilities Act. Actions such as these are what it takes to make New York the most inclusive, integrated and accessible state to live in.” Legislation (S.7107b/A.8586b) recognizes Supported Decision-Making as a less restrictive alternative to guardianship that promotes autonomy for people with intellectual and developmental disabilities and empowers them to take an active role in making choices about their own lives. Historically, when individuals with disabilities have reached adulthood, guardianship has been the primary avenue for decision-making. Supported Decision-Making changes the landscape in empowering individuals to make their own decisions with the support of a trusted person in their lives, while ensuring person-centered care and maximizing individual civil rights. The new law will formalize the legal process by which an individual with intellectual and developmental disabilities and trusted persons in their lives can reach a written agreement (a “Supported Decision-Making Agreement”) that describes the settings in which the individual desires support, the kinds of support they want from each trusted person, and how they want to receive that support. It will also create obligations and corresponding immunity from liability for third parties to honor and effectuate supported decisions made using a Supported Decision-Making Agreement. Legislation (S.6300c/A.7356c) requires OPWDD to develop and implement a public awareness campaign that combats discrimination stigma and stereotyping of people with developmental disabilities. The program will utilize public forums, social and mass media, the Internet, radio, and print advertising to educate the public about developmental disabilities and highlight positive contributions people with developmental disabilities make to the state and their communities. State Senator John W. Mannion said, “As Chair of the Disabilities Committee, I have vigorously pursued an agenda of equality and fairness for every New Yorker with a disability and their families and Governor Kathy Hochul has been a true partner in these efforts. These new laws will make our state more inclusive by combatting stigma and ensuring those who need services have a voice in their care and life decisions.” Legislation (A.7882a/S.6789a) replaces references to “mentally retarded” in numerous sections of New York State law to more accurate terms such as with “people with intellectual or developmental disabilities.” Legislation (S.6195-B A.7443-C) replaces certain references to “mentally retarded” or “mentally ill” persons with the term “individuals with a developmental disability.” New York demonstrates respect for a marginalized population by replacing archaic and offensive terms with modern and acceptable terms that are representative of the respect and dignity that people with intellectual and developmental disabilities deserve. Legislation (A.7652/S.9335) eliminates the state residency requirement for designated beneficiaries in the New York Achieving a Better Life Experience (ABLE) program, which is designed to help pay for qualified disability expenses. Conforming state law with the federal ABLE Act will increase participation in New York’s ABLE program, lower administrative costs, and benefit program account owners. In addition to the bills signed today, Governor Hochul highlighted legislation that was signed earlier this month that increases enforcement of rules related to disabled access parking spaces (A9805 /S882) and increases fines for dumping or plowing snow onto accessible parking places (A9702B /S 1271-B). These bills demonstrate the state’s commitment to ensuring equal access for people with disabilities. Onondaga County 7th District Legislator Mary Kuhn, on July 25th at 12 noon, held what was billed as a “No Aquarium” protest and press conference. According to Kuhn,” Onondaga County Executive Ryan McMahon continues his curiously persistent campaign to lobby politicians for support for his Aquarium. It is expected to be considered at a Legislature Ways & Means meeting on Tuesday, despite bipartisan opposition and the lack of community support.” Kuhn continued, “Recently the County Executive announced an additional “Science Advisory Committee”, as if more committees were what was needed. We are gathering today to expose this charade as the County Executive refuses to listen to the voices of the taxpayers of Onondaga County.” The proposed aquarium has become controversial as advocates want more resources allocated to human services. The County Executive has maintained in statements that the project would be good for Onondaga County. That being said, Mary Kuhn called for those that are against the aquarium gather at Columbus Circle. The suburban legislator capsulizes her opinion in one sentence,  “This is not a sustainable project, this is theft of tax payer dollars”. – Mary Kuhn The following is a portion of statements by Legislator Kuhn during the press conference. “We have a poverty we have 14% of our our citizens in the county live under the poverty line.  20% or one in five children live in poverty.  25% of our families earn less than $30,000 a year. so here’s something we could consider; a child tax cut, Republicans are always talking about tax cuts, right? how about a child tax cut that is modeled On the federal child tax credit. Data proves that this kind of support for families helps reduce poverty. Everybody knows what’s happening with inflation right now. Groceries are high, gas is high, rents are out of control, clothing is out of control. We have one opportunity here to really address issues of poverty.  The Republican Party in this community has a very bad track record when it comes to what, this aquarium supposed to be, “transformational”.  This is going to be transformational; it’s going to change everything in our community. we’ve had several of these, let’s look at a couple. How about the carousel center? Our County Executive was on the City Council at that time and was supportive of that.  That was fun for a couple of years, but then we needed to expand it, we need to be bigger, we needed to have a Disneyland down there. With an expanded destiny, I think we all know what happened to that. Right now, we have a mall that’s valued at about $170 million, that is in debt for over $300 million. That’s what happened to that. Then there was a hotel near the mall that was supposed to also . Now people can come and stay right there and go shopping, right there. That hotel is now standing on land that is in bankruptcy. Oh, then there’s the film hub, you remember the film hub? The film hub’s gonna be transformative, and recently a national publication had us in the top ten of government boondoggles. In other words, the waste of the taxpayer dollars.  We have the Solara light bulb factory. Attorney General James Announces Arrest and Arraignment of Correction Officer on Murder and Manslaughter Charges

Dion Middleton Was Off-Duty When He Allegedly Fatally Shot an 18-Year-Old in the Bronx New York – New York Attorney General Letitia James announced the arrest and arraignment of Dion Middleton, 45, of the Bronx, on charges of Murder in the Second Degree and Manslaughter in the First and Second Degrees in connection with the shooting death of Raymond Chaluisant, 18. Dion Middleton is a Correction Officer with the New York City Department of Correction (DOC). Middleton was arraigned today before Judge Jeffrey Zimmerman of Bronx Criminal Court. Judge Zimmerman set bail at $1 million bond or partially secured bond, with $500,000 cash or credit card alternatives. “My office is committed to a thorough and transparent investigation of every case where an officer of the law may have caused a death,” said Attorney General James. “I offer my sincere condolences to the family of Mr. Chaluisant, and the people of New York have my pledge that we will work to see that justice is served.” On Thursday, July 21, shortly after 1 a.m. during an encounter in the vicinity of the Cross Bronx Expressway and Morris Avenue in the Bronx, Middleton is alleged to have shot at a car in which Raymond Chaluisant was a passenger, killing Chaluisant. Middleton then left the scene and reported to work later that morning, where he was apprehended by the New York City Police Department (NYPD). Pursuant to New York Executive Law Section 70-b, the Attorney General’s Office of Special Investigation (OSI) assesses every incident reported to it where a police officer or a peace officer, including a corrections officer, may have caused the death of a person, by an act or omission. Under the law, the officer may be on-duty or off-duty, and the decedent may be armed or unarmed. Also, the decedent may or may not be in custody or incarcerated. If OSI’s assessment indicates an officer caused the death, OSI proceeds to conduct a full investigation of the incident. The charges are merely accusations, and the defendant is presumed innocent until and unless found guilty.
