A.G. Schneiderman and Acting Tax Commissioner Manion Announce Felony Conviction Of Former CEO of Multi-Million Dollar Energy Company

Gary Mole, Former CEO of Glacial Energy Holdings, Diverted Over $18.5 Million In Taxable Income To Congolese Mining Operation And Failed To Pay Hundreds of Thousands In Taxes ALBANY – Attorney General Eric T. Schneiderman and Acting Commissioner of Taxation and Finance Nonie Manion today announced the plea and conviction of Gary Mole, 52, an Australian citizen and the former CEO of Glacial Energy Holdings (“GEH”), stemming from the underreporting of over $18.5 million dollars in taxable income by Glacial Energy of New York (“GENY”), a wholly owned subsidiary of GEH.  Mole pleaded guilty to Criminal Tax Fraud in the Second Degree, a class C felony. Co-defendant GENY was previously convicted of the same crime after pleading guilty on December 3, 2015. “By diverting millions in income, this defendant showed no regard for the integrity of our tax system or for the many New Yorkers who would be left footing the bill. No matter how elaborate the scheme, those who seek to avoid paying their fair share of taxes will be caught and punished,” said Attorney General Schneiderman. “This guilty plea should send a powerful reminder to every business owner: those who attempt to evade their tax obligations through criminal schemes will pay a price,” said NYS Tax Department Acting Commissioner Nonie Manion. “We will continue to work with the Attorney General’s Office and all of our law enforcement partners to ensure that violators face justice.” According to prosecutors, from 2006 through 2008, Mole was the CEO and sole shareholder of GEH, an energy service company incorporated in Nevada. In approximately 2006, Mole allegedly began personally investing taxable revenue of GENY in a mining operation in the Democratic Republic of Congo (“DRC”), Generales Des Mines Au Congo SPRL, known as “Gemico.” Between January 1, 2006 and December 31, 2008 Mole diverted over $18.5 million in taxable revenue from GENY to Gemico. Mole instructed subordinates to wire money to bank accounts in the Democratic Republic of Congo, Switzerland, Lichtenstein, South Africa, and China, among others, all for the benefit of Gemico. Mole and GENY then improperly deducted the monies invested in Gemico as consulting expenses on GENY’s tax returns for years 2006, 2007 and 2008, thereby understating GENY’s New York State taxable income by millions of dollars. In order to conceal and justify the false accounting of the payments to Gemico as consulting expenses, in 2007, Mole and a former employee at GEH created and backdated a consulting agreement between Gemico and Glacial and fake invoices from Gemico to Glacial. As a result of the fraud, Mole and GENY evaded a total of over $670,000 in New York State income taxes. Mole and GENY were indicted by an Albany County Grand Jury in September  2015 and charged jointly with three counts of Criminal Tax Fraud in the Second Degree, a class C felony, and three counts of Offering a False Instrument for Filing in the First Degree, a class E felony.  GENY pleaded guilty on December 3, 2015 to the crime of Criminal Tax Fraud in the Second Degree, a class C felony, and agreed to pay full restitution to the New York State Tax Department. Today, Mole entered a plea of guilty to the crime of Criminal Tax Fraud in the Second Degree, a class C felony, in satisfaction of the pending indictment.  As a condition of his plea, he repaid $335,000 in restitution to the State of New York.  Mole, a citizen of Australia who is currently in the United States on a work visa, was sentenced to an unconditional discharge and agreed to satisfy the remaining restitution by entering a judgment against himself in favor of the New York State Tax Department. Mole pleaded guilty before Hon. Roger D. McDonough in Albany County Supreme Court. This case arose out of a joint investigation by the Attorney General’s Taxpayer Protection Bureau and the New York State Department of Taxation and Finance. The case was subsequently referred to the Attorney General’s Criminal Enforcement and Financial Crimes Bureau for criminal investigation and prosecution. The Attorney General’s Office thanks the New York State Department of Taxation and Finance for its invaluable assistance. The investigation was conducted by New York State Department of Taxation and Finance, Criminal Investigations Division Forensic Tax Auditor II William Welch with the assistance of the Attorney General investigators, under the supervision of Deputy Chief Investigator Antoine Karam. The Attorney General’s Investigations Bureau is led by Chief Dominick Zarrella. The case is being prosecuted by Assistant Attorneys General Benjamin S. Clark and Philip V. Apruzzese of the Criminal Enforcement and Financial Crimes Bureau and Nicholas Suplina, currently Senior Advisor and Special Counsel to the Attorney General and formerly of the Attorney General’s Taxpayer Protection Bureau. Forensic auditing was provided by Associate Forensic Auditor Meaghan E. Scovello from the Forensic Audit Section, led by Chief Auditor Edward J. Keegan, Jr.  The Criminal Enforcement and Financial Crimes Bureau is led by Bureau Chief Gary Fishman and Deputy Bureau Chief Stephanie Swenton.  The Taxpayer Protection Bureau is led by Bureau Chief Thomas Teige Carroll.

Recognizing the Legacy of Dr. Martin Luther King, Jr.

A Salute to Music Educator and Artist Dr. Joan Rucker Hillsman “It’s a Day On – Not a Day Off”!  said Dr. Joan Rucker Hillsman to one of her music classes in the 70’s. Even before the bill was ever passed that the great Civil Rights Leader, Dr. Martin Luther King, Jr.’s day would become a national holiday, Joan, as many called her was “working on his dream”, said Danny Queen, renowned poet. Doc, as she is affectionately known, has inspired generations, helping them to live out and pursue their talents and dreams.  Her passion for helping others with her sometimes “laid back” persona, has the tendency of making others feeling comfortable around her. The “Day on-Not a Day Off concept” was embraced, as she walked into her classroom, and the students were literally jubilant, rejoicing and in high spirits.  When she inquired as to what was going on, one student said, “Dr. King’s day will be a holiday and we will have the DAY OFF”. That became a teaching point for her, as she is known for doing.  Her reply was, “It’s not a Day off-but should be a Day On”- a day to “Work on His” dream by embracing his principles and all that he stood for. “Well, today, my lesson plan has changed. Take out your journals and write why you think Dr. King should be honored for his works.”  This project became a school project expanded curricula and disciplines.  Essay contests, songs, paintings and signs going up in the building slogans saying, “We are Working on the Dream..Are you”? This year, 2017, marks the 36th year for Dr. Joan Hillsman, along with others at New Southern Rock Baptist Church, Washington, D. C., (Rev. Rudolph White, Senior Pastor) who has spearheaded the activity, “A Day On”. It started when she was Minister of Music in D.C., under her leadership, with approximately eight people who decided that on Dr. King’s holiday, with essential workers (nurses, firemen, and policemen, etc.) that they would have a lunch hour showing clips of Dr. King’s life on the screen as they stopped by around 12 Noon for the opportunity to celebrate the dreamer. The community suddenly embraced the idea and wanted to come as well. The rest is history! Ever since that time the celebration, has expanded to become an Annual Dr. King Day event on his Birthday. The event has now grown from an audience of 8 to-approximately 200 strong, which includes music, poetry, tributes, dance and a wide variety of community participants. All proceeds from the program were sent to The MLK Center for Social Change Atlanta, Georgia. Since the establishment of the King Memorial at the Monument, the proceeds from this program supports those efforts. Dr. Hillsman relocated to Syracuse, NY. She is the proud mother of the Head Women’s Basketball, Coach Quentin Hillsman. “She has not skipped a beat”, as far as supporting the community projects and the arts in Syracuse, as one of her supporters stated. She flies in to Washington, D. C. on a 6 AM flight, enroute to the King Monument on the Mall, and then to the Annual Ceremony. But wait, prior to the time of the King Celebration there, she goes to Atlanta, Georgia (Late Husband’s Home town) to pick up materials and mementos from the renowned Ebernezer Church, to be distributed to schools and community organizations.  This is to motivate them to “Work on their Dreams”. Dr. Hillsman volunteers for many organizations and partnerships in the Syracuse area, including the Annual Syracuse University’s Dr. King Celebration, Harriet Tubman, Community Folk Art Center, and The Gospel Music Workshop of America. Tucker Missionary Baptist Church, Syracuse, NY has now embraced-The Day On-Not a Day Off Ceremony.

Simplify Tax Time by Gathering Financial Documents Ahead of Filing Season

Good recordkeeping reduces errors and supports eligibility for tax credits and deductions The New York State Department of Taxation and Finance today encouraged taxpayers to begin gathering and organizing their 2016 financial records in preparation of tax season. Receiving any tax credit or deduction hinges on the ability of taxpayers to prove their earned income and expenses claimed on their income tax return. “With less than one week left in 2016, taxpayers can simplify the filing season by compiling their financial documents now,” said Acting Commissioner of Taxation and Finance Nonie Manion. “With the proper documentation taxpayers are more likely to be able to successfully claim potentially valuable credits and deductions.” Records to collect Gather documents, including bank statements, deposit slips, canceled checks, and invoices. Business owners—including the self-employed—must compile records of each sale, including the sales price, the sales tax collected, cash register receipts, and credit card sales slips. Records for the self-employed should contain enough information to accurately show the tax year’s gross receipts, business expenses, and the purchase price of assets and inventory. Tax records should be maintained for at least three years as it could impact a taxpayer’s ability to prove eligibility for valuable credits such as the Earned Income Tax Credit (EITC). New York State Bar Association Urges Action on Legislation to Strengthen Indigent Criminal Defense Services

ALBANY, NY (12/31/2016)(readMedia)– Governor Andrew Cuomo has vetoed a bill (S.8114 and A.10706) that would have required the State of New York to gradually assume the costs of providing constitutionally-mandated legal representation to indigent criminal defendants. The bill was approved by the state Legislature with unanimous, bipartisan support. It called for a seven-year phase-in of state assumption of the costs, now largely borne by county governments. In a statement, New York State Bar Association President Claire P. Gutekunst said: “We are disappointed by the Governor’s veto. Sponsors Senator John DeFrancisco and Assemblywoman Patricia Fahey crafted a thoughtful bill that had widespread support from county governments, the legal community and community organizations. “The State Bar Association’s priority continues to be enactment of a law to ensure that New York’s public criminal defense system provides meaningful legal representation to all indigent criminal defendants in New York, in accordance with the U.S. Supreme Court’s ruling in Gideon v. Wainwright (1963). “We hope to work with the Governor and Legislature to accomplish that goal early in the new year.”
